GENERAL TERMS AND CONDITIONS OF USE


A) Object

  1. This website is operated by Turismo Motivatours, Lda, head office at Avenida 5 de Outubro - Edifício Coral - 1.º S, Almancil, with VAT number 503171310, and a Social Capital of 99.760 euros, registered at the Loulé Commercial Registry under the number 3960, with the Licence Approved by the Government 665/93, hereinafter called Motivatours;
  2. The general conditions here established have the object to define the terms and conditions, through which the services supplied by this website will follow;
  3. This website offers a wide range of products and services related to travel and leisure, which all the licensed tourism professionals are allowed to make reservations if accomplish the established requirements, each case particularly, by Motivatours;
  4. The technical organisation of any brochure and information presented on the Website was carried out by Motivatours;
  5. Motivatours only act as an intermediary between the clients and the services suppliers included in the brochure or in this website;
  6. All the product and service range offered in this website are subject to the terms and conditions here mentioned, excluding any particular condition provided, which will prevail over the general condition;
  7. When the User visit, book or contract Motivatours through this website, he is accepting the mentioned conditions;
  8. The knowledge of the present conditions do not invalidate the consultation of the particular conditions when applicable on a particular product or service provided by Motivatours;
  9. The User is finantially responsible for the services contracted by himself through this website;
  10. The User only can reserve products or services to a third party when himself figures on the reservation, with the final client information;
  11. The information given by the User is of his own responsibility, compromising to vouch the truth and exactitude of it;
  12. The User agrees that the use of this Website will only be authorised according to the general and particular conditions and according to the legislation in force, and that any violation of these matters gives the authority to Motivatours cancel the access of the User.


B) The Use of the Website

You cannot modify, reproduce, exhibit to the public or distribute, neither use on any kind of public and comercial utilisation the contents of this website. It is forbidden any utilisation, for any matter, of the contents of this website in any other website or computer, unless if Motivatours authorises. The contents of this Website are protected by copyrights and its non authorised utilisation would violate laws referring to copyrights, brands and others. If you violate the terms of this Website, and if you have authorisation to use this Website, this authorisation will automatically be cancelled.


C) Website Contents

  1. The contents of this Website is subject to changes or updates without prior notice; so, in any moment, Motivatours can perform improvements and/or changes to the products and/or information displayed, without informing previously the users;
  2. The photos displayed on the Motivatours Website can eventually not correspond to the descriptions, and the information can have technical or type errors;
  3. The rates and specifications are subject to amendment without prior notice, being that Motivatours decline any responsibility for any type errors displayed on the Website;
  4. Motivatours do not intend to receive any confidential information through this Website. Any material or information that is sent to us, to be displayed in this Website, will not be considered as confidential and not protected by copyrights;
  5. It is forbidden to affix or to transmit to the Website, and from it, illegal, threatening, defamatory, obscene, pornographic, or other type of information that violate any legal or regulamentar disposals;
  6. Motivatours guarantees the safety to the right of all data protection, given by the user and authorised by him, which will be treated with confidentiality predicted by the national and community laws, giving to its holder the right to, in the future, have access to the data to change, add or even ask to erase it, if existing on the records;
  7. The accommodation localization on the map is only a reference . We cannot assure you its precision.


D) Accommodation Organisation and Booking

  1. The rates are disposed as following, excluding specific programmes mentioned:
    1. Hotels: rate per person/night including breakfast (excluding when there is a breakfast supplement), based on double room occupancy. Check-in from 14h00 and check-out until 12h00.
    2. Apartments: rate per apartment/night. The extra bed and meals supplements are per person/day. When booking, the information regarding the total number of people (adults and children) occupying the apartment is of the responsibility of the client. The apartment can reject the entrance of the client in case that more people are presented that the ones who were previously booked. Check-in from 16h00 and check-out until 10h00. When the client receives the booking confirmation he should ask the check-in and check-out time of the accommodation.
  2. The presented rates include all country taxes, excluding any exception informed un the product description.
  3. The payment systems available are described on the website or on the contracts individualy made with the users.


E) Booking and cancellation costs

  1. The cancellation costs will be calculated over the services value as following
    1. Cancellation up to 30 days prior arrival, subject to a payment of 25% of the booking total cost;
    2. Cancellation during the 30 days prior arrival, the client will have to pay all the charges that will come eventually from the cacellation, including the supplier, administrative and expedient costs, or other that may result.
  2. Due to internal rules, some hotel units included on this website or in one of its brochure can eventually ask for an extra fee at the check-in (value defined by the unit). The refund will be made at the end of the stay after they have checked the room/apartment, in accordance with each unit rules, where Motivatours is not related with.


F) Information and Complaints

  1. Complaints can only be considered if presented in writing to the agency where the booking and its payment has been made, in a period up to 20 days after the end of the service. These complaints only will be accepted if they were presented to the supplier during the stay, receiving their supporting documents;
  2. Motivatours is member of the Customer Regulatory. Every complaints have to be presented in writing up to 20 days after the end of the service, and sent to Rua Duque de Palmela, 2-1º Dº- 1250-098 Lisboa, Portugal;
  3. The Customer Regulatory decisions should be held up to 30 days after his reception of the complaint. Those decisions are always informed in writing to the travel agency so that this one corrects the irregular situation, if it exists, and the agency has 30 days, from the information of the decision, to fulfil it.
  4. Any client's doubt about the products or services presented by Motivatours should be duly exposed on work days, before the use of the product or service, or else Motivatours will not be responsible for any damage caused;
  5. Motivatours has at the clients disposal the telephone line +351 289 390 000, for informations, clarifications, complaints and other subjects about the present general terms and conditions of use.


G) Lugadge and other services

  1. The apartments have daily cleaning service, excluding on Saturday, Sunday and bank holidays, towels and sheets change: once a week and do not include dish washing. Some units can have a cleaning service with more or less frequency, so the Client should always get informed about it;
  2. On any case Motivatours will not be responsible for the lugadge and/or other assets that the client carries with him, independently from the place or mean of transportation given; A lugadge insurance is recommended since this is an external and unfamiliar service to Motivatours;
  3. The Client should travel with all his personal identification duly up to date.


H) Other disposals

  1. The responsibility of Motivatours, emergent of the assumed obligations, is by a civil liability insurance on the Insurance Company Tranquilidade, licence nº 0001017438 and a caution (bank warranty nº 93232-24990000) at the bank BPI on the terms of the legislation in force;
  2. In case of legal dispute between the two parties, about the interpretation, application or execution of the present conditions, the competent authority will be the Court of Loulé.


I) Access Suspension or Termination

  1. Motivatours reserves the right to terminate or suspend the access to the Website to any User, for the necessary time, for any technical, administrative reasons or others.
  2. Without prejudice to the previous note, Motivatours cannot be responsabilized for any access suspension or termination that is not from its fault or due to the user negligence.


J) Review of website terms

Motivatours can eventually review the conditions of this website at any moment, updating this text. You should visit this webpage regularly to notice the changes of the applied conditions, since you are bound to these Terms of Use, everytime you will use this website. Some information can be transcended by news or other terms presented in the webpages of this Website or others from Motivatours property, since existing links mention it.
